活动介绍

Many international treaties establish “in-house” mechanisms to facilitate implementation and promote compliance of parties. These mechanisms exist alongside other means of dispute resolution, for example through International Courts and Tribunals (ICTs). Yet, the functions of these mechanisms are in some cases overlapping with those of ICTs, ranging from providing authoritative interpretations, rendering advisory opinions, inquiring into Parties’ compliance, to the resolution of disputes between parties.

In this project, we asks:

Whether and why in some circumstances the use of more informal NCMs might be more effective to bring states into compliance with their treaty obligations or address situations of non-compliance than the recourse to ICTs for breach of a treaty;

How NCMs and other means of dispute resolution, such as international courts, relate to each other; and what their comparative advantages and disadvantages are.

Selected abstract authors will be notified in August 2021. PluriCourts plans a research conference (either hybrid or online) in October 2021 with the selected authors and invited speakers to discuss the contributions. Papers (max. 8.000 words incl. footnotes) are due on 30 January 2022. Contributions will be published in an edited volume by Cambridge University Press (tbc) or a special edition of a legal journal (tbc).

The Indian Journal of International Law (IJIL) is a quarterly journal, an internationally refereed publication. The Editorial Board (EB) of IJIL invites submissions for Volume 61, Number 1, which is due to be published in December 2021. The EB welcomes long, in-depth articles and short articles, notes and commentaries, case note, recent development on any aspect of public or private international law. The EB particularly encourages submissions that are relevant to the developing countries, Asian and African approaches to International Law and India.

Hélène Ruiz Fabri (Max Planck Institute Luxembourg for Procedural Law), Stephan Schill (University of Amsterdam), and Sandrine Maljean-Dubois (Aix-Marseille University) have announced a Call for Papers for a Special Issue of The Journal of World Investment & Trade on ‘International Investment Law and Climate Change’.

Authors interested in contributing an article to this Special Issue should submit extended abstracts of no more than 500 words along with brief biographical information (at 300 words maximum) by 15 June 2021. These proposals should be sent by email to the Journal of World Investment & Trade <jwit@mpi.lu>.

Authors of accepted papers will be invited to join a digital workshop on 18-19 November 2021 where all participants can exchange comments on more complete drafts of around 4,000-5,000 words. The deadline for final drafts (8,000-10,000 words) will be at the end of February 2022.

第五届民诉法学研究的实体之维学术研讨会预通知

为促进对《民法典》实施的研究，进一步推动程序与实体、理论与实践的学术交流，西南政法大学比较民事诉讼法研究中心拟定于2021年10月下旬或11月上旬举办“第五届民诉法学研究的实体之维学术研讨会”，会议将待有关部门批准后发出正式邀请，会议方式视疫情发展情况再行通知，现将有关事项进行说明。

征文主题

会议主题为“《民法典》的诉讼衔接与执行实施”，会议将主要围绕以下（不限于）议题展开研讨：

（一）《民法典》的实施与当事人制度的协调

（二）《民法典》的实施与审判程序的衔接

（三）《民法典》的实施与证据制度的发展

（四）《民法典》的实施与执行制度的保障

投稿须知

（一）欢迎法学院校的科研人员、实务部门的工作者以及在读博士生等积极投稿，尤其欢迎实体法方向的专家学者投稿或申请参会。
